Collect Terms of Use

1. App licence and Apple terms

Collect is licensed, not sold. Unless a custom end-user licence agreement is provided through the App Store, your licence to use Collect is also governed by Apple’s Standard Licensed Application End User License Agreement (the Apple Standard EULA). These Terms supplement the Apple Standard EULA. If there is an inconsistency, the Apple Standard EULA applies to the app licence, and these Terms apply to Collect’s features, purchases, and services, except where mandatory law requires otherwise.

You may use Collect only on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules and the Apple Standard EULA.

If you are under the age of legal majority where you live, a parent or guardian must review and accept these Terms on your behalf. Collect is not directed to children under 13.

2. Entry limits and purchase options

Collect may be used without payment subject to a journal-wide limit on saved entries, also described in the app as photo memories or entries. The limit applies across your entire Collect journal, not separately to each album. The applicable free limit will be shown in the app and may change from time to time.

A change to the free limit will not delete or prevent access to entries already in your journal. If your journal is at or above the applicable limit, you cannot create another entry unless you delete enough entries to make room, begin a subscription, or purchase Lifetime.

Subscriptions and Lifetime only change the number of entries you can add; they do not unlock additional app features. Collect offers two purchase options:

• an auto-renewing monthly subscription; and
• a non-consumable one-time purchase called Lifetime.

The features, price, currency, and billing period applicable to an offer are shown in Collect and in the App Store before you confirm a purchase. The terms displayed at the time of purchase form part of these Terms.

Family Sharing is not supported. A paid entitlement applies to the Apple Account used to make or restore the purchase and may be used on that person’s supported devices where Apple and Collect make the entitlement available.

3. Monthly subscription

The monthly subscription allows you to create unlimited entries while the subscription is active.

The subscription renews automatically each month unless it is cancelled before the renewal date. Payment is charged to the Apple Account used to confirm the purchase. Apple processes billing, renewal, cancellation, and payment information under its own terms.

You can view, manage, or cancel the subscription through your Apple Account subscription settings. Deleting Collect does not cancel a subscription.

When you cancel, unlimited-entry access continues until the end of the paid billing period shown in your Apple subscription settings, unless the subscription is refunded or revoked earlier. At the end of that period, Collect returns to the free entry limit unless you purchase Lifetime or begin another subscription.

If your journal is at or above the applicable free limit when unlimited-entry access ends:

• Collect will not delete those entries;
• you may continue to view, edit, export, and delete existing entries; and
• you cannot create additional entries while your journal is at or above the applicable free limit, unless you resubscribe or purchase Lifetime.

4. Lifetime

Lifetime is a non-consumable, one-time in-app purchase that allows you to create unlimited entries in supported versions of Collect without recurring subscription charges.

“Lifetime” refers to the lifetime of the Collect product and does not guarantee that Collect, the App Store, a particular feature, or compatibility with every future device or operating-system version will remain available forever. It means that Collect will not require a further recurring payment from that Apple Account to create unlimited entries in supported versions of the app, subject to these Terms and applicable law.

Lifetime is not transferable and does not support Family Sharing.

5. Existing Collect users

You are eligible for a complimentary Lifetime entitlement if, before Collect version 4.0.0 was released on the App Store, you:

• purchased or installed Collect; or
• purchased any in-app purchase previously offered in Collect.

Eligible users receive Lifetime at no additional cost and do not need a subscription to retain unlimited-entry access.

This legacy entitlement has no cash value, is not transferable, and does not create a right to a refund for a previous purchase. If you believe the entitlement has not been recognized correctly, contact support@updraftstudio.ai.

6. Prices, price changes, taxes, and refunds

Prices are displayed in the App Store and may vary by country, region, currency, and tax treatment. The full amount charged for a billing period will be shown before you confirm a purchase.

Apple may notify you of subscription price changes and request your consent where required. If required consent is not provided, the subscription may not renew at the new price.

Apple processes App Store payments and refund requests. Refund eligibility is determined by Apple and applicable law. Nothing in these Terms limits any refund, cancellation, consumer-guarantee, or other right that cannot lawfully be excluded.

7. Restoring purchases

You can use Restore Purchases in Collect to ask Apple to restore an eligible subscription or Lifetime entitlement associated with the relevant Apple Account. A purchase may not restore if it was made with a different Apple Account, refunded, revoked, or is otherwise no longer recognized as valid by Apple.

8. Your journal content

You retain ownership of the photos, titles, notes, tags, albums, and other journal content you add to Collect.

You are responsible for having the rights and permissions needed to use, store, export, or share that content. Do not use Collect to infringe another person’s intellectual property, privacy, publicity, or other legal rights.

Collect primarily stores journal content on your device. Optional iCloud Sync and other data practices are described in the Collect Privacy Policy. You are responsible for maintaining appropriate device, iCloud, or exported backups for content that matters to you. No storage or synchronization system can be guaranteed to prevent every loss, corruption, or synchronization error.

9. Acceptable use

You must not:

• copy, modify, distribute, sell, lease, sublicense, reverse engineer, or attempt to derive Collect’s source code, except where applicable law expressly permits it;
• interfere with Collect’s operation, security, purchase verification, or entitlement systems;
• bypass or attempt to bypass the free entry limit or any purchase requirement;
• use Collect unlawfully or to violate another person’s rights; or
• use Collect in a way that could damage the app, its users, Apple services, or third-party services.

10. App changes and availability

The App Developer may update Collect to add, change, improve, replace, or discontinue features. Changes may be necessary for security, reliability, legal compliance, compatibility with Apple platforms, or continued operation.

The App Developer will provide the unlimited-entry entitlement offered for an active paid subscription period, subject to temporary outages, technical limitations, device and operating-system compatibility, and circumstances outside the App Developer’s reasonable control. The App Developer will not intentionally remove an existing paid entitlement merely to require the same user to purchase it again.

If the App Developer discontinues a purchase option or unlimited-entry entitlement, the App Developer will handle existing entitlements consistently with applicable law and Apple’s requirements and provide reasonable notice where practicable.

11. Intellectual property

Collect, including its software, design, branding, text, graphics, and other materials provided by the App Developer, is owned by the App Developer or the relevant licensors and is protected by intellectual-property laws. These Terms do not transfer ownership of Collect or its intellectual property to you.

12. Third-party services

Collect may interact with services provided by Apple and other third parties, including the App Store, StoreKit, iCloud, Photos, Files, Mail, and destinations you choose when exporting or sharing. Those services are governed by their own terms and privacy policies. The App Developer is not responsible for third-party services to the extent permitted by applicable law.

13. Consumer rights, disclaimers, and liability

Collect comes with rights and guarantees that may not be excluded under the Australian Consumer Law and other applicable consumer laws. Nothing in these Terms excludes, restricts, or modifies a right, guarantee, remedy, or liability where doing so would be unlawful.

To the extent permitted by law, Collect is provided “as is” and “as available.” The App Developer does not guarantee uninterrupted or error-free operation, compatibility with every device or operating-system version, or that every loss of locally stored or synchronized content can be prevented.

To the extent permitted by law, the App Developer is not liable for indirect, incidental, special, consequential, or exemplary loss arising from your use of Collect. Any limitation applies only to the extent it is fair, reasonable, and lawful in the circumstances.

14. Changes to these Terms

These Terms may be updated when Collect’s features, purchases, business model, or legal obligations change. The current version will be posted at the same web address with a revised effective date.

Material changes will be communicated in an appropriate way before they take effect where reasonably practicable or legally required. Changes will not retroactively remove accrued rights or entitlements where doing so would be unlawful.

15. Governing law

These Terms are governed by applicable Australian law. You may also have mandatory rights under the laws of the country or region where you live. Nothing in these Terms requires you to give up those rights or prevents you from bringing a claim in a forum available to you under applicable law.

16. Apple

These Terms are between you and the App Developer, not Apple. Apple is not responsible for Collect or for providing maintenance or support for it, except as required by law or Apple’s own terms. Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent required by the Apple Standard EULA and may enforce the applicable terms against you.
